Platform Rules
These Platform Rules (hereinafter - the "Rules") govern the conduct of user conduct on the website DitWork located at https://ditwork.com, as well as the use of all related pages, sections, profiles, account functions, internal communication tools, publication features, user interactions, proposal mechanisms, orders, Connects, moderation, settlement-related functionality, Balance-related functionality, and other elements of the digital service (hereinafter - the "Platform").
These Rules form an integral part of the Public Offer / Terms of Service of the Platform. Registration on the Platform, login to an account, use of the Platform, publication of orders, submission of proposals, correspondence, interaction with other users, and any other use of the Platform mean that the User has read, understood, and accepted these Rules in full.
If the User does not agree with these Rules in whole or in part, the User must immediately stop using the Platform.
1. General provisions
1.1. The Platform is a digital service intended to enable interaction between clients and freelancers, publication of orders, submission of proposals, internal communication, support of order performance, use of Connects, internal settlement-related functionality, and other related features provided under the Platform rules.
1.2. The Platform acts solely as an intermediary and operator of a digital service and is not a party to the underlying contract between the client and the freelancer unless expressly stated otherwise in separate Platform documents.
1.3. The User must use the Platform in good faith, lawfully, reasonably, respectfully toward other users, and strictly in accordance with these Rules, the Public Offer, the Privacy Policy, and any other Platform rules.
1.4. The Platform Administration may, at its discretion, establish, amend, supplement, interpret, and enforce these Rules to the extent not inconsistent with mandatory applicable law.
1.5. The Administration may use automated, semi-automated, and manual means of control, filtering, analysis, monitoring, restriction, blocking, moderation, and enforcement for the purposes of safety, compliance with these Rules, abuse prevention, user protection, and protection of the Platform's legitimate interests.
2. User account
2.1. The User must provide only truthful, current, and non-misleading information when registering, activating an account, completing a profile, and further using the Platform.
2.2. The User must ensure the security of login credentials, password, authentication tools, email, Telegram activation access, and any other tools used to access the account.
2.3. The User may not transfer the account, login, password, account access, or authentication tools to third parties without the Platform's express permission.
2.4. The User may not create or use multiple accounts for the purpose of bypassing restrictions, blocks, limits, Connect rules, feature restrictions, moderation, or other Platform mechanisms.
2.5. The User may not use another person's account, personal data, contact details, email, phone number, Google account, Telegram account, or other third-party authentication tools without lawful grounds.
2.6. The User must promptly notify the Administration through support of any suspected account compromise, loss of access, unauthorized use, or attempted breach.
3. Communication between users only within the Platform
3.1. All negotiations, messages, discussion of order terms, agreement on price, deadlines, stages, revisions, materials, files, work result, acceptance, settlement-related matters, claims, disputes, and any other issues related to an order or a potential order must be carried out exclusively through the Platform's official communication tools.
3.2. Communication between users outside the Platform without the Platform's express permission is prohibited where such communication is related to an order, a potential order, cooperation, payment, transfer of materials, discussion of services, or any other interaction that arose on or in connection with the Platform.
3.3. Users are prohibited from requesting, sending, publishing, masking, encoding, hiding, exchanging, or otherwise distributing off-platform contact details, including email addresses, phone numbers, messenger usernames, links to Telegram, WhatsApp, Viber, Signal, Discord, Skype, Zoom, Google Meet, social networks, external websites, external profiles, personal pages, portfolio links containing contacts, or any other means of communication, where the purpose or effect of such action is to bypass the Platform.
3.3.1. Users are also prohibited from publishing, sending, masking, shortening, encoding, embedding in images, files, QR codes, signatures, portfolios, service descriptions, order descriptions, reviews, comments, attachments, or other materials any links to third-party resources where the purpose or effect of such placement may be to divert a user away from the Platform, move communications outside the Platform, move a transaction outside the Platform, bypass the Platform rules, bypass the Platform Commission, or conceal contacts and communications from the Platform. Such links include, without limitation, links to personal websites, external portfolios, social media pages, messengers, contact aggregators, contact forms, pages containing usernames, external marketplaces, call-booking services, and any intermediate, shortened, redirecting, or otherwise disguised links.
3.4. Users are prohibited from inviting each other to continue communication outside the Platform, or from moving order discussions to messengers, social networks, email, phone, video calls, or any other external channels, unless the Platform has expressly permitted this in writing.
3.5. Any attempt to move a client or freelancer to external communication channels, hide negotiations from the Platform, deprive the Platform of the ability to monitor, moderate, preserve evidence, apply safe deal rules, settlement rules, Connect rules, or obtain commercial benefit outside the Platform shall constitute a material breach of these Rules.
3.6. The Administration may use internal correspondence, user actions, technical signals, complaints, automated filters, and other reasonable review methods to detect attempts to bypass the Platform and engage in off-platform communication.
4. All order-related actions must be performed through the Platform
4.1. All key order-related actions must be carried out through the functionality provided by the Platform, including publication of the order, submission of a proposal, selection of a freelancer, discussion of terms, correspondence, transfer of information, confirmation of stages, confirmation of the result, settlement-related actions, and other actions where the relevant functionality is available on the Platform.
4.2. The User may not use the Platform merely for initial contact, client acquisition, freelancer acquisition, or moving the transaction to an external environment without completing the interaction through the Platform.
4.3. If a particular action can technically be performed through the Platform, the User must use the Platform functionality rather than hidden, indirect, or external methods of interaction.
4.4. Circumvention of Platform functionality, creation of fictitious activity, use of intentionally incomplete orders, empty proposals, encoded messages, hidden contacts, or any other artificial methods intended to move a transaction outside the Platform is prohibited.
5. Respectful conduct and prohibition of insults
5.1. The User must behave properly, respectfully, and in good faith toward other users, the Administration, moderators, support staff, and any other persons interacting through the Platform.
5.2. The Platform prohibits insults, humiliation, harassment, hate speech, discriminatory statements, threats, blackmail, extortion, abusive language, aggressive pressure, psychological pressure, manipulation, intimidation, and any other forms of toxic or unacceptable conduct.
5.3. It is prohibited to publish or send materials containing violence, calls for violence, unlawful activity, extremist materials, pornography, spam, fraudulent messages, malicious files, phishing links, malicious instructions, or any other content violating law, third-party rights, or these Rules.
5.4. It is prohibited to use the Platform for persecution, provocation, harassment, discrediting others, false complaints, mass attacks on ratings, artificial lowering of another user's reputation, or any other forms of bad-faith pressure.
6. Honesty, good faith, and prohibition of abuse
6.1. The User may not mislead other users regarding identity, experience, competence, status, service price, order content, deadlines, intentions, rights in the work result, guarantees, or any other material circumstances.
6.2. It is prohibited to use the Platform for fraud, scam activity, fake orders, fake bids, false profiles, fictitious proposals, artificial demand generation, artificial review generation, rating manipulation, abuse of complaints, or other dishonest conduct.
6.3. It is prohibited to use the Platform to distribute malicious software, scripts, hidden links, trackers, phishing pages, viruses, archives with harmful content, or any other technically dangerous materials.
6.4. It is prohibited to test Platform vulnerabilities, scan infrastructure, bypass protective mechanisms, interfere with code, attempt unauthorized access, automate actions without permission, or use bots, scripts, parsers, or other means that may disrupt the normal functioning of the Platform.
6.5. It is prohibited to use the Platform in a way that may infringe third-party rights, intellectual property rights, privacy rights, consumer rights, reputation rights, or any other legally protected interests.
7. Connects and functional limits
7.1. If the Platform uses a Connect system or another internal limited digital functionality for submitting proposals, bids, or other actions, the User must use such functionality strictly in accordance with the Platform rules.
7.2. The User is prohibited from circumventing Connect limits, artificially obtaining additional Connects, using Platform errors, multiple accounts, automation, manipulation, or any other means of unlawfully obtaining an advantage.
7.3. If the Platform rules provide that Connects are refreshed on the first day of each month and unused Connects expire, the User accepts such order of use of the digital functionality and may not demand monetary compensation for unused Connects, except where otherwise expressly required by mandatory applicable law.
7.4. Additional Connects, where purchased by the User, are also used only under the Platform rules and may have a limited validity period where expressly provided by the rules, tariffs, or interface of the Platform.
8. User content
8.1. The User bears full responsibility for any text, file, image, message, comment, order, proposal, service description, attachment, link, review, or other content that the User publishes, transmits, uploads, stores, or otherwise makes available on the Platform.
8.2. The User may not publish unlawful, false, misleading, third-party, rights-infringing, malicious, spam, manipulative, contact-masking, or otherwise prohibited content.
8.3. The Administration may, without prior notice, hide, restrict, reject, remove, edit, block, or otherwise limit access to content that in its opinion violates these Rules, the Public Offer, the Privacy Policy, applicable law, or creates risk for the Platform or its users.
8.4. The Administration is not obliged to publish any content submitted or created by a user and is not obliged to explain the reasons for every moderation decision unless expressly required by mandatory law.
9. Moderation, restrictions, and account blocking
9.1. For violation of these Rules, the Administration may apply any measures it considers necessary and proportionate, including a warning, content hiding, account feature restriction, messaging restriction, publication restriction, proposal restriction, Connect restriction, temporary account suspension, permanent account blocking, cancellation of internal functionality, suspension of access to particular sections, rejection of operations, withholding of available amounts pending review, and any other measures предусмотренные Platform rules.
9.2. Account blocking may be applied both for a single material breach and for a combination of breaches, suspicious activity, Platform circumvention, off-platform communication, abusive conduct, fraud, technical abuse, user complaints, account compromise, breach of law, or any other risk to the Platform, its users, or its infrastructure.
9.3. The Administration may block an account without prior notice where it believes delay may lead to harm, abuse, loss of evidence, data leakage, infringement of user rights, Platform circumvention, or other significant risks.
9.4. The Administration is not obliged to restore an account, internal functionality, access to correspondence, access to publications, rating, Connects, or other account elements after blocking unless expressly required by mandatory law or by a separate decision of the Administration.
10. Complaints, review, and support interaction
10.1. The User may submit complaints, appeals, and reports of violations through the Platform's official support channels.
10.2. The Administration may, but is not obliged to, review any complaint, dispute, violation report, or technical incident at its own discretion and to a reasonable extent.
10.3. When reviewing complaints and investigations, the Administration may use Platform correspondence, technical logs, user actions, profile data, account history, internal records, automated signals, complaints from other users, and any other materials lawfully available to the Platform.
10.4. The User must interact with support in good faith and may not submit knowingly false complaints, abuse support requests, pressure support personnel, threaten Platform representatives, or use support as a manipulation tool.
11. Limitation of Platform liability under these Rules
11.1. The Platform is not liable for the content, accuracy, quality, timing, legality, results, conduct, intentions, solvency, communications, actions, or omissions of users.
11.2. The Platform does not guarantee that any user will act in good faith, be qualified, be solvent, be safe, or that any order will be performed properly.
11.3. The Platform is not liable for damage arising from the actions or omissions of other users, external services, external messengers, third-party providers, hosting, communication failures, technical errors, hacking, spam, fraud, insults, non-performance of obligations between users, or other circumstances beyond the Platform's reasonable control, except where otherwise expressly required by mandatory applicable law.
11.4. To the maximum extent permitted by applicable law, the Platform may independently determine the order of moderation, restriction, review, blocking, and enforcement, and the User accepts that such measures may be applied in the interests of safety, rule compliance, and protection of the Platform's legitimate interests.
12. Amendment of the Rules
12.1. The Administration may at any time amend, supplement, revise, or replace these Rules.
12.2. The updated version of the Rules becomes effective from the moment of publication on the Platform unless a different effective date is expressly stated.
12.3. Continued use of the Platform after publication of a new version of the Rules means the User's acceptance of such changes unless otherwise required by mandatory law.
