Microtasks Service Offer
This Microtasks Service Offer is an integral part of the DitWork Public Offer and Terms of Service published at: https://ditwork.com/de/terms. It establishes special rules for creating, publishing, performing, reviewing, and paying for microtasks. If a special provision of this Offer differs from a general provision of the Public Offer, this special provision applies to the Microtasks Service to the extent permitted by Applicable Law.
1. Terms and scope
1.1. A Microtask is an offer published by a Client to perform a specified action or sequence of actions under stated conditions for a stated reward after acceptance of the result.
1.2. A Client is a User who creates, funds, publishes, or otherwise manages a Microtask.
1.3. A Worker is a User who reserves a Microtask, performs its conditions, and submits a Result for review.
1.4. A Result is information, text, a file, an image, a link, or other evidence submitted by a Worker to confirm performance of a Microtask.
1.5. A Reservation is the temporary allocation of an available Microtask place to a Worker for a period set by the Client or the Platform.
1.6. A Task Budget is an amount recorded by the Platform for accepted Results and applicable fees within the Service functionality.
1.7. By using the Microtasks Service as a Client or Worker, the User confirms that the User has read, understood, and accepted this Offer, the general Public Offer, Platform Rules, and Privacy Policy.
2. Role of the Platform
2.1. The Platform provides technical tools for publishing Microtasks, reserving places, submitting Results, review, internal reward accounting, communication, and moderation.
2.2. The Platform is not an employer, representative, partner, agent, fiduciary, bank, payment system, or party to a separate arrangement between a Client and a Worker unless Applicable Law or a separate written agreement expressly provides otherwise.
2.3. The Client independently determines the content of a lawful Microtask, the reward, number of available completions, deadline, review criteria, and permitted Result format within the Platform capabilities.
2.4. The Worker independently assesses the terms, complexity, safety, and suitability of a Microtask. Reserving a Microtask does not create an employment relationship with the Client or the Administration.
2.5. The Administration does not guarantee publication of any Microtask, availability of Workers, receipt of a particular number of Results, Result quality, any marketing or commercial outcome, or performance by a particular deadline.
3. Creation and content of a Microtask
3.1. The Client must provide a clear, complete, and unambiguous description. Before reservation, the Worker must be able to see all material terms, including required actions, acceptance criteria, evidence format, deadline, reward, and material restrictions.
3.2. The Client may not conceal required actions, increase the scope after reservation, demand undisclosed registrations, payments, purchases, subscriptions, documents, or personal data, or apply criteria that were unavailable before performance began.
3.3. The title, description, materials, link, category, access settings, and evidence format must correspond to the actual substance of the Microtask. Misleading wording, substitution of purpose, and concealment of prohibited activity behind a neutral description are prohibited.
3.4. The Client must possess all rights, permissions, and lawful grounds required to publish the materials, links, trademarks, personal data, and instructions used in the Microtask.
3.5. If performance is limited to particular countries, ages, devices, operating systems, or categories of Users, the Client must disclose the limitation in advance and use available Platform restrictions.
3.6. A Microtask must not encourage the Worker to violate any law, third-party right, contractual obligation, or rule of a website, application, social network, application store, advertising system, or other external service.
4. Absolute prohibition on KYC and financial identification
4.1. Microtasks that directly or indirectly require KYC, identification, or identity verification on cryptocurrency exchanges, banks, payment systems, brokerage, investment, lending, insurance, crowdfunding, exchange, financial technology, or other financial services for the benefit of the Client or any third party are prohibited.
4.2. This prohibition covers passports, international passports, ID cards, residence permits, driving licences, tax identification numbers, bank statements, utility bills, proof of address, source of funds or income, and any other personal or financial documents.
4.3. A Microtask may not require a selfie with or without a document, a photograph or scan of a face, fingerprints or other biometric characteristics, a voice recording, video identification, a video call with a service representative, a liveness check, or disclosure of any biometric data.
4.4. A Microtask may not require opening or verifying a bank, payment, brokerage, investment, cryptocurrency, or other financial account; issuing a card; creating a wallet; obtaining credit, a loan, instalment financing, insurance, or an investment product; making a deposit; acquiring a financial asset; completing a transaction; or obtaining a bonus for the benefit of the Client or a third party.
4.5. A Microtask may not require disclosure or transfer of an account, login, password, SMS code, one-time code, backup code, key, seed phrase, token, email access, device access, telephone number, card, account, wallet, or two-factor authentication method.
4.6. The prohibition applies regardless of the reward, a statement that participation is voluntary, a promise to delete data, use of the Worker's own authentic documents, description of the task as testing or registration, absence of any transfer of funds, or an assurance by the Client that the activity is lawful.
4.7. A prohibited procedure may not be divided between multiple Microtasks, Users, or stages, and no intermediary, external instruction, chat, file, QR code, or link may be used to circumvent this prohibition.
4.8. The Worker must not perform such a Microtask and must stop performance if a prohibited requirement becomes known after reservation. The Worker should report the Microtask to the Support Service.
5. Competing and similar services
5.1. Without the Administration's prior written permission, Microtasks intended to promote, populate, test, develop, or use a service that wholly or partly competes with DitWork or provides similar freelancer search, freelance service, microtask, crowdsourcing, paid-action, or digital-work functionality are prohibited.
5.2. The prohibition includes registering or verifying accounts on such a service; publishing tasks, services, projects, applications, reviews, or offers; performing tasks; recruiting clients or workers; transferring an audience; mass-producing content; simulating activity; increasing metrics; collecting data; or testing a competing service's interfaces.
5.3. Microtasks may not be used to advertise a competing service, distribute its referral links, incentivize visits or registrations, perform comparative promotion, solicit Users away from the Platform, or collect contact details for transferring interaction to that service.
5.4. The Administration determines whether an external product is competing or similar by considering its purpose, functions, audience, payment model, and the actual substance of the Microtask.
5.5. An exception is valid only if the Administration has given prior written permission for the specific Client and specific Microtask.
6. Other prohibited Microtasks
6.1. Microtasks involving fraud, phishing, deception, money laundering, unlawful cash conversion, unlawful dealing in property, circumvention of mandatory controls, creation of nominee accounts, or concealment of the true beneficiary are prohibited.
6.2. Tasks requiring the Worker to make a payment, purchase with personal funds, pay an advance, transfer money, or receive or forward funds, goods, SIM cards, bank cards, documents, or parcels are prohibited unless the Administration expressly permits the relevant format.
6.3. Tasks designed to artificially or misleadingly increase reviews, ratings, votes, reactions, followers, installations, orders, applications, visits, or other metrics are prohibited where they violate law, consumer rights, or external-service rules.
6.4. Distribution of malware, unauthorized access, circumvention of technical restrictions, mass account creation, spam, collection of private data, doxing, harassment, threats, discrimination, and other dangerous or unlawful activity are prohibited.
6.5. Tasks involving unlawful content, exploitation of minors, sexual services, prohibited goods, weapons, narcotic substances, forged documents, unlicensed financial services, or other objects whose circulation is prohibited or restricted are prohibited.
6.6. This list is not exhaustive. The Administration may restrict another Microtask where its content, purpose, method of performance, or likely consequences create a material legal, financial, reputational, information-security, or other risk.
7. Moderation and refusal to publish
7.1. Every Microtask may be reviewed automatically or manually before publication, after publication, after an edit, upon receipt of a complaint, or at any stage of performance.
7.2. Acting in its reasonable discretion, the Administration may refuse publication, return a Microtask for revision, restrict access, suspend, unpublish, hide, block, or delete it where it violates or may violate this Offer, other Platform rules, Applicable Law, third-party rights, or creates an unacceptable risk.
7.3. A Client's Microtask may be rejected without publication of the reason. The Administration is not required to publicly disclose the grounds for its decision, review algorithms, fraud indicators, internal security criteria, complaint details, or detection methods.
7.4. Where appropriate and where doing so does not create a risk of circumvention, the Administration may communicate a general category of violation or suggest a revision, but is not required to provide detailed advice, evidence, or an opportunity to republish.
7.5. Earlier publication of a similar Microtask, the absence of an immediate response, passage of automated review, or publication of another User's task does not constitute approval and does not restrict subsequent moderation.
7.6. The Administration may request information about the purpose, promoted subject, beneficiary, rights to materials, lawful basis for data processing, and intended use of Results. Failure to provide sufficient information is an independent ground for restriction.
7.7. A moderation decision applies without prejudice to a User's mandatory statutory rights. The User may contact the Support Service, but an appeal does not by itself suspend the decision.
8. Reservation and performance
8.1. A Worker may reserve only a Microtask that the Worker intends to perform personally, in good faith, and within the stated deadline.
8.2. Reserving places through multiple accounts, transferring a Reservation to another person, using unauthorized automation, submitting the same Result for multiple Users, or circumventing repeat-performance limits is prohibited.
8.3. When the Reservation period expires, the place may be released automatically. Incomplete work and time spent do not by themselves create a right to a reward.
8.4. The Worker must comply with the terms in effect when the Reservation was made. If the Client changes material terms after reservation, the Worker may discontinue performance and notify the Administration.
8.5. The Worker independently provides the device, connectivity, software, and other resources needed for lawful performance unless the Microtask expressly states otherwise.
9. Results and evidence of performance
9.1. A Result must be authentic, attributable to the particular Worker and Reservation, comply with the required format, and reasonably demonstrate performance.
9.2. Forged, altered, or third-party evidence, reuse of a Result, concealment of material circumstances, presentation of automated activity as personal activity, and manipulation of review data are prohibited.
9.3. A Worker must not disclose data that is unnecessary for review. Passwords, access codes, payment details, complete document numbers, biometric information, and other excessive confidential information must not be submitted through the Result form.
9.4. The Client may use a Result only for the disclosed lawful purpose and must have an appropriate lawful basis for processing personal data contained in it.
9.5. The Administration may retain performance-related records to the extent and for the period needed to operate the Service, investigate violations, handle requests, and fulfil legal obligations.
10. Review, acceptance, and rejection of a Result
10.1. The Client must review a Result in good faith, within the stated period, and according to criteria available to the Worker before performance began.
10.2. A compliant Result must be accepted. If a defect can be corrected, the Client may return the Result for revision with a clear statement of what must be corrected. In the event of a material failure, the Client may reject the Result with an explanation through the available interface.
10.3. The Client may not reject a compliant Result to obtain completed work without payment, reduce costs, replace the original requirements with new ones, or discriminate against the Worker.
10.4. The Administration may re-review any Result before or after the initial decision if there are indications of deception, a prohibited task, a breach of rules, duplication, collusion, erroneous credit, technical error, payment reversal, or abuse.
10.5. Following re-review, the Administration may cancel or change an acceptance decision, reject the Result, return it for revision, adjust internal records, suspend access to the reward, or apply other measures permitted by Platform rules and law.
10.6. The Administration may reject a Result without publicly disclosing the reason or internal fraud criteria. Where the law or circumstances require notice to the User, the required information will be provided.
10.7. An Administration decision within an internal process is not a judicial or arbitral award and does not restrict the User's non-waivable rights.
11. Reward and Task Budget
11.1. A reward becomes available to the Worker after the Result has been accepted and Platform checks have been completed. Until then, a displayed amount is not unconditionally due for payment.
11.2. The Client must maintain a sufficient Task Budget. If the budget is insufficient, the Platform may suspend new Reservations and publication of the Microtask.
11.3. Fees, conversion rules, minimum amounts, and available deposit or payout methods are governed by the general Platform terms and the interface available to the User.
11.4. If a Microtask is cancelled, deleted, or restricted, the unused portion of its Task Budget is accounted for under Platform rules. Amounts relating to disputed, suspicious, or accepted Results may be held during review.
11.5. A prohibited Microtask creates no right to demand its publication, completion, or payment for unlawful activity. Refunds and further accounting are handled with regard to actual operations, fees, claims, payment reversals, and legal requirements.
12. Complaints, review, and retention of information
12.1. A User may report a violation through available tools or the Support Service at: https://ditwork.com/de/support.
12.2. A report should identify the Microtask, describe the circumstances, and include available evidence. Knowingly false reports, falsified information, and use of complaints to pressure another User are prohibited.
12.3. During a review, the Administration may suspend the Microtask, Reservation, Result acceptance, internal credit, payout of related funds, or particular Users' access to the Microtasks Service.
12.4. The Administration may consider the Microtask and Result, activity history, messages, technical indicators, account connections, complaints, payment events, and other lawfully available information.
12.5. The Administration is not required to disclose information affecting another person's rights, Platform security, confidentiality of an investigation, contractual restrictions, or legally protected secrecy.
13. User responsibility
13.1. The Client is responsible for the lawfulness of the purpose, content, and intended use of Results, accuracy of the description, possession of rights and permissions, sufficiency of review criteria, and fulfilment of obligations to Workers.
13.2. The Worker is responsible for the lawful method of performance, authenticity of submitted evidence, compliance with the terms, and avoidance of third-party or excessive personal data.
13.3. To the extent permitted by Applicable Law and the general Public Offer, a User must compensate documented losses, costs, and third-party claims caused by the User's breach.
13.4. For a breach of this Offer, the Administration may restrict creation or performance of Microtasks, block a function or account, cancel a Reservation, adjust internal records, and apply other proportionate measures.
13.5. Application of one measure does not prevent other measures, communication with a payment partner, preservation of evidence, or disclosure to a competent authority where a lawful basis exists.
14. Changes and discontinuation
14.1. The Administration may change Microtask functionality, limits, categories, Reservation, review, payment, and moderation rules, and this Offer, subject to the general Public Offer and Applicable Law.
14.2. A new version applies from the date stated upon publication unless the version itself or law requires a later effective date.
14.3. Continuing to create new Microtasks, make Reservations, or submit new Results after a change takes effect constitutes acceptance of the updated terms. This does not restrict the User's mandatory rights.
14.4. The Administration may temporarily or permanently discontinue all or part of the Microtasks Service. Unfinished relations and internal records will be handled according to the applicable terms, actual circumstances, and legal requirements.
15. Final provisions
15.1. The provisions on Applicable Law, dispute resolution, electronic communications, severability, and language priority in the general Public Offer apply to this Offer.
15.2. If any provision of this Offer cannot be enforced, the remaining provisions remain effective and the affected provision applies to the maximum extent permitted by law.
15.3. The Administration's decision not to apply a particular measure in one situation does not waive its right to apply that measure later or to another breach.
15.4. The current version of this Offer is published at: https://ditwork.com/de/microtasks-terms
15.5. Translations are provided for convenience. If language versions conflict, the Ukrainian-language version prevails, except where mandatory law or a consumer's non-waivable rights require otherwise.
